The client, a 35 year member of Local 22, received an application for criminal complaint after being stopped by police who accused him of being involved in a low street level drug transaction. The client hired Boston Criminal Defense Lawyer Steven J. Topazio to represent him. According to the police report, the police alleged they witnessed the passenger of the vehicle the client was operating, exit the motor vehicle and engage in a drug transaction with other individuals. The other individuals, who were observed engaging in what was believed was a drug transaction, then entered an unknown address before the police could stop and question them. The police thereafter approached the client’s vehicle with badges displayed in order to conduct a threshold inquiry. Due to the client’s alleged hand movements, the officers ordered the client out of the vehicle and searched him and found a small bag of coke on the client. Instead of arresting the client, he was told that he would be summonsed to court for a Magistrate hearing. Today, Boston Criminal Attorney Topazio spoke with the officer and Magistrate in an attempt to resolve the case without the issuance of a criminal complaint. Boston Criminal Lawyer Topazio pointed out the problems with the stop and suggested that the case be continued to a later date to see if the case could not be resolved in the Magistrate’s session in lieu of the police insisting that a compliant issue and the Magistrate agreed.
