The client, a 52 year old mother of one, caught her boyfriend with another woman. After being caught, the boyfriend obtained an ex-parte restraining order against the client. The client thereafter attempted to delete the now ex-boyfriend’s telephone contacts from her cell-phone but inadvertently dialed the ex-boyfriend and accused of violating the restraining order and received an Application for Criminal Complaint. The client thereafter hired Boston Criminal Defense Lawyer Steven J. Topazio to represent her. Attorney Topazio explained to his client that under the certain circumstances Magistrates have limited authority to resolve matters and may exercise their authority to resolve local conflicts short of authorizing a criminal complaint. Today, at the Magistrate’s hearing, Attorney Topazio acknowledged the inadvertent nature of the contact and despite the alleged violation, persuaded the Magistrate to dismiss the complaint against his client.
