The client, who received a civil motor vehicle citation for traveling 80 MPH in a 55 MPH zone, appealed the citation and hired Criminal Attorney Steven J. Topazio to represent him. Attorney Topazio reviewed the citation which alleged that it was given on a clear dry day and that the Trooper clocked the Client for over ½ mile. Attorney Topazio is aware that exceeding 50MPH for a distance of 1/4 of a mile or more on a divided highway outside a thickly settled area constitutes an unreasonable speed. Today, Attorney Topazio argued that when his client had attempted to merge from the middle lane into the right lane he was blocked by other vehicles and sped up to go around a line of traffic so as not to miss his exit. As a result of his understanding of the hearing process, Attorney Topazio was successful in convincing the Magistrate to find his Client not responsible.
