The client, a 77 year old retired Postal Worker and Navy Veteran, received a summons to appear for a Magistrate Hearing after striking a woman with his motor vehicle while in the Stop & Shop parking lot in Revere, hired Boston Criminal Attorney Steven J. Topazio to defend him. Attorney Topazio obtained the Revere Police report which indicated that his client had road rage and began swearing and yelling at the alleged victim who as a result of his client’s actions blocked his car. When the alleged victim did not move out of the way of the client’s motor vehicle, the report stated that he struck the alleged victim with his car causing her to fall to the ground. Attorney Topazio discovered the alleged victim had retained counsel and had filed a personal injury claim against his client. Today, Attorney Topazio argued that his client was confused on the day in question and did not know whether he was in drive or reverse when his motor vehicle accidently struck the other party. Attorney Topazio pointed out that the victim’s personal injury claim would be denied if the criminal complaint issued since his client’s insurance company would only pay for negligent acts, and persuaded the Magistrate not to issue the complaint.
