The Client, a 35 year old business analyst, hired Attorney Topazio to represent him at a Clerk Magistrate Hearing after receiving an application for criminal complaint. The client, who possessed a medical marijuana card, was accused of mailing marijuana via Federal Express to his brother who resided out of state. The FedEx package the client sent was identified at Logan Airport when the FedEx driver who picked up the package could smell a strong and obvious odor of marijuana coming from the back of his truck where the package was located. The package was X-rayed at Logan airport by State Police where a vegetable-like substance could be seen inside. The client put his name and address on the package which led the police to the client. When the State Police contacted the client, they read him his Miranda warnings, and the client admitted mailing the marijuana to his brother via FedEx but claimed that he had a Medical Marijuana card. Attorney Topazio argued that the client in essence wanted to mail the marijuana to himself so he could have it when he visited his brother out of state, and was successful in convincing the Magistrate to dismiss the complaint against his client.
