When police responded to a radio call for a DVIP (domestic violence in progress), they were met by the client and his wife who stated they were in an argument. When the wife stated her husband grabbed her by the arm and then pushed her into a wall, the husband was arrested. The client, a 31 year old professional with a master’s degree, working in the United States with an H-1B work Visa, hired Attorney Steven Topazio to represent him. An H-1B is a non-immigrant visa that allows US companies to employ foreign workers in specialty occupations. Domestic abuse or spousal abuse, under Federal law however, is considered a crime of moral turpitude and as a result a deportable offense. As such the client absolutely needed the charges against him dismissed. Attorney Steven Topazio met with the wife and the wife’s family, along with the prosecutor assigned to the case to structure a solution. Today, on the day of trial, Attorney Topazio was successful in getting the charge of domestic assault and battery against his client dismissed.
