The clients, a mother, father and daughter, received a summons for a Magistrate Hearing for shoplifting a designer handbag from a department store and hired Boston Criminal Lawyer Steven J. Topazio to represent them. According to the merchant, the father was seen carrying wire cutters into the store and the family was later seen removing the security tag of a Michael Kors handbag and then hiding it in an empty shopping bag. According to statute, any person who intentionally transfers any merchandise displayed, held, stored or offered for sale by any store or other retail mercantile establishment from the container in or on which the same shall be displayed to any other container with intent to deprive the merchant of all or some part of the retail value thereof shall be guilty of shoplifting. Today after a full hearing in front of the Clerk Magistrate, Attorney Topazio convinced the Magistrate to dismiss all charges.
